By accessing or using the PeopleSense platform (the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.
We reserve the right to update or modify these Terms at any time. Your continued use of the Service after any such changes indicates your acceptance of the new Terms. We will notify you of any material changes by posting the new Terms on this page.
User Obligations
Account Security
You are responsible for maintaining the confidentiality of your credentials and all activities under your account.
Lawful Use
You agree to use the Service only for lawful purposes and in compliance with all applicable local and international laws.
You shall not: (a) reverse engineer or attempt to derive the source code of the Service; (b) use the Service to build a competitive product; (c) upload or transmit viruses or malicious code; or (d) interfere with the security features of the Service.
Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of PeopleSense and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
By submitting content to the Service, you grant PeopleSense a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of providing and improving the Service.
Limitation of Liability
"To the maximum extent permitted by applicable law, in no event shall PeopleSense, its affiliates, or its licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill."
In no event shall our aggregate liability for all claims related to the Service exceed the total amount paid by you to PeopleSense for the Service during the twelve (12) months prior to the event giving rise to the claim.
Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
